Terms and Conditions

2. Agreement to these Terms

These Terms govern your use of the Orbit app and website. By creating an account you agree to them and confirm you have read our Privacy Policy. If you don't agree, please don't use Orbit.

Eligibility. You must be at least 18 years old and able to enter into a binding contract. Orbit is for personal, non-commercial use.

3. The service

Orbit gives you a daily dashboard built from your Garmin data, journal and habits: Recovery, Strain and Sleep scores, training and meal tools, habit tracking and an AI Coach. We may improve, change or remove features over time; if we remove a feature you have paid for, we will tell you in advance.

4. Health disclaimer

Orbit is a wellness tool, not a medical device, and does not provide medical advice. Its scores, patterns, training and meal suggestions are for general information and motivation only. They do not diagnose, treat, cure or prevent any disease, and they are not a substitute for a doctor, dietitian or qualified trainer.

  • Always consult a healthcare professional before starting a new exercise or diet plan, especially if you have a medical condition, are pregnant or take medication.
  • Stop exercising and seek medical help if you feel pain, dizziness or shortness of breath.
  • Wearable data can be inaccurate. Never ignore professional medical advice or delay seeking it because of something Orbit shows you.
  • In an emergency, call 112.

5. The AI Coach

The Coach is an artificial intelligence system, not a human. Its answers are generated automatically from your data and may be incomplete, inaccurate or unsuitable for you. Use your own judgement, and treat any workout or diet day the Coach drafts as a suggestion for you to review, not an instruction.

6. Your account

You are responsible for keeping your login details secure and for activity on your account. Tell us at [Contact email] if you think someone has accessed it without permission. One account per person; accounts may not be shared or transferred.

7. Acceptable use

You agree not to:

  • Break any law, or use Orbit to harm yourself or others.
  • Try to access other users' data, our servers or source code without permission, or interfere with Orbit's security.
  • Reverse-engineer, copy, resell or build a competing service from Orbit, except where law allows it.
  • Use bots, scrapers or automated means to access Orbit, or overload our systems.
  • Try to make the AI Coach produce harmful, illegal or abusive content.

8. Your content

Your data and the content you enter (journal entries, meals, habits, Coach messages, your avatar) remain yours. You give us a limited licence to store and process it solely to provide Orbit to you, as described in our Privacy Policy. We do not use it to train AI models or for advertising.

Orbit's software, design, scores, question sets and brand belong to [Controller name] and are protected by intellectual property law. You get a personal, non-exclusive, non-transferable right to use the app while your account is active.

9. Garmin and other third parties

Garmin data reaches Orbit only when you connect your Garmin account. Your use of Garmin devices and services is governed by Garmin's own terms. We are not responsible for Garmin's availability, accuracy or any interruption in the data it sends. Garmin is a trademark of Garmin Ltd. or its subsidiaries; Orbit is not affiliated with or endorsed by Garmin.

10. Price and payment

[Choose one and delete the other.]

Option A — free: Orbit is currently free. If we introduce paid features, we will tell you the price clearly before you are charged, and you will never be charged without agreeing.

Option B — paid: Orbit costs [price, VAT included] per [month/year]. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time in [Settings / your app store account], and cancellation takes effect at the end of the current period. We will give you at least 30 days' notice of any price change, and you may cancel before it applies. Purchases made through Apple's App Store or Google Play are also subject to their payment terms.

11. Right of withdrawal (EU consumers)

As a consumer in the EU, you have 14 days from the day you subscribe to withdraw from the contract without giving a reason. To do so, email [Contact email] with a clear statement, or use the model form below. We will refund you within 14 days using the same payment method.

If you ask us to start the paid service immediately and acknowledge that you lose your withdrawal right once it has been fully provided, we may deduct an amount proportional to the service you used before withdrawing.

Model withdrawal form — To [Controller name], [Address], [Contact email]: I hereby give notice that I withdraw from my contract for the Orbit subscription ordered on [date]. Name: [ ]. Account email: [ ]. Date: [ ].

12. Availability and liability

We work to keep Orbit available and accurate, but we cannot guarantee it will be uninterrupted or error-free, or that scores and suggestions will be right for you.

To the extent permitted by law, we are not liable for indirect losses, or for decisions you make based on Orbit's scores, suggestions or Coach answers. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or wilful misconduct, or any rights you have as a consumer under Spanish and EU law that cannot be excluded.

13. Ending the agreement

You can stop using Orbit and delete your account at any time in Settings. We may suspend or close your account if you seriously or repeatedly break these Terms, after warning you where reasonable. If we discontinue Orbit, we will give you at least 30 days' notice, a chance to export your data and a pro-rata refund of any prepaid period.

14. Changes to these Terms

We may update these Terms to reflect changes in the law or in Orbit. We will notify you in the app and by email at least 30 days before significant changes take effect. If you don't agree, you can close your account before then.

15. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, you may bring a claim in the courts of your place of residence, and you keep the protection of the mandatory laws of your country. You can also contact us first at [Contact email] — most issues can be solved quickly — or use your regional consumer arbitration board (in Catalonia, the Agència Catalana del Consum).
